Asbestos victims file 6.6 billion yen class action lawsuit in Tokyo

Construction workers and next of kin of deceased workers filed a lawsuit in Tokyo, Japan Friday seeking damages of approximately 6.6 billion yen (about US$64 million) from the government and manufacturers related to illnesses stemming from exposure to asbestos. 178 plaintiffs; including construction workers and family members filed the suit in Tokyo District Court against 46 building manufacturers and the Government of Japan.

According to the Mainichi Daily News, the class action suit is the first that has been filed in Japan related to health damages caused by asbestos exposure at construction sites. The plaintiffs hail from the Japanese prefectures of Tokyo, Saitama and Chiba.

The plaintiffs claim that the government and manufacturers knew of the dangers of asbestos inhalation but failed to take proper precautions, including ceasing to promote asbestos as a cheap fire retardant and banning production of the material.

They state that after inhaling asbestos in the workplace, 172 people have developed lung cancer or mesothelioma, and that almost half of those afflicted are now dead. Plaintiffs argue that the government and health ministry did not act quickly enough after international organizations issued warnings in 1972 that asbestos could be a carcinogen.

Plaintiffs also place blame with the Ministry of Economy, Trade and Industry for sanctioning the use of asbestos under Japanese Industrial Standards, and with the Ministry of Land, Infrastructure and Transport for approving the use of materials comprised of asbestos and other substances under Japan’s Building Standards Law.

“We will do our utmost until we win the suit,” said Kazuo Miyajima, 78, who heads the group of plaintiffs. Lawyers for the plaintiffs released a statement saying: “We seek complete relief for the victims by clarifying the liability of the state and the manufacturers.”

Approximately 40 construction workers from Kanagawa Prefecture plan to file a similar lawsuit in June in Yokohama District Court.

After a 2005 revelation that residents who lived near a factory in Amagasaki, Hyogo Prefecture developed diseases related to asbestos, the government implemented a law in 2006 which provides monetary assistance to asbestos victims and relatives of deceased family members. The plaintiffs argue that the amount of financial assistance given to families and victims of asbestos-related diseases is not sufficient.

Asbestos has been used in Japan as a fire retardant, for sound absorption, and for insulation. It was mixed in concrete and water and sprayed on walls and ceilings, but the practice of spraying asbestos in this manner was banned in Japan in 1975.

Elizabeth May elected leader of Canada’s Green Party

Elizabeth May has been elected leader of the Green Party of Canada today, winning the position with 2,145 votes or 65.34 per cent of ballot cast. She beat her nearest rival, environmental consultant and Green deputy leader David Chernushenko by a margin of almost 2 to 1. Jim Fannon, the third candidate, finished far back with only 29 votes. The new leader will replace Jim Harris, who stepped down after holding the position since 2003.

In her acceptance speech, May called on the federal government to give notice that Canada will withdraw from the North American Free Trade Agreement in order to force the United States to renegotiate the treaty.

May, a long-time environmental activist and former executive director of the Sierra Club of Canada takes over the party which received 4.5 per cent of the popular vote in the last federal election, enough to secure over $1 million a year in federal funding but not enough to elect any of its candidates to the Canadian House of Commons. Chernushenko won the highest vote percentage of any Green candidate in the January election winning 10% of the vote in Ottawa Centre.

“We draw pretty much equally from across the entire political spectrum,” Jim Harris told CBC News. “If you were a Progressive Conservative, as I was, where do you go? The Green party supports Kyoto. We were opposed to the war in Iraq and yet at the same time we’re fiscally responsible. This is something that’s attractive to people.”

“What we need to do is clearly build a method and a platform so that they are not voting for ‘none of the above’ but so that they are voting for ‘all my dreams,’ ” said May after her victory.

The race has brought new people to the party with membership rising from 5,517 to 8,694 in recent months.

The New Zealand Police has reported that a three-year-old boy choked to death on Saturday afternoon, due to what they believe was a piece of candy at his birthday party.

The parents did call New Zealand’s emergency number, 1-1-1, after their son alerted his parents to the fact that he was choking. The paramedics were unable to revive the Napier boy when they arrived at the scene.

The case has been referred to a coroner.

Relatively unknown golfer Zach Johnson won the 71st Masters Tournament in Augusta, Georgia. Johnson shot 3-under-par 69 in Sunday’s fourth round, to win by 2 strokes over Tiger Woods, Retief Goosen, and Rory Sabbattini.

Johnson won a purse worth US$1,305,000 and a lifetime qualification to the Masters Tournament, held annually at the Augusta National Golf Club.

NYC taxicabs

A couple living in New York City have decided to take a taxi all the way to Arizona. Betty and Bob Matas are retiring and leaving the city for good. What started as joke, has become reality, in part to spare their cats from traveling in a jetliner cargo-hold. They have negotiated a US$3,000 flat fee instead of the metered rate, which was estimated at US$5,000.

Houston, Texas

A vocational nurse working for Dr. John Capriotti, a plastic surgeon, was accused of setting the fire that wounded several and killed three people in Houston, Texas on March 28. She was allegedly trying to cover up the fact that she hadn’t completed the paperwork for an upcoming audit.

The fire began in Dr. Capriotti’s office on the fifth floor and quickly spread to the sixth. Arson investigators from the Houston Fire Department, the FBI and the Federal Bureau of Alcohol, Tobacco, Firearms and Explosives had been working to determine the source of the fire.

Iran’s nuclear program

Iran announced that it has started industrial scale production of nuclear fuel involving hundreds of centrifuges. The announcement comes as President Mahmoud Ahmadinejad reasserts his nation’s nuclear rights in the face of two rounds of sanctions by the UN Security Council, which is seeking a halt to such work.

The United States denounced the declaration, saying it showed Iran was defying the international community.

Galician emigrant Rufino López receives 2013 Spanish-American International Award

Emigrant Rufino Lopez, born in Cedeira, Galicia, Spain in 1955, was awarded on Wednesday with the 2013 Spanish-American International Award by the Spanish Benevolent Society of New York.

Graduated in literature by the Lehman College of CUNY in 1976, Rufino Lopez has preserved his admiration to the great figures of Spanish literary and philosophical tradition, as Unamuno and Ortega y Gasset, or Cervantes, while shaping the Solera Restaurant, located in the city of New York for more than twenty years, near the United Nations Headquarters. Rufino is the only son of Galician Francisco Lopez, who emigrated to New York City as a construction worker in 1971.

While studying, Rufino Lopez worked in Italian and French restaurants, finding no Spanish restaurants that could represent the high value of Spanish cuisine in the Big Apple. In 1987 he founded his first restaurant, called Alcalá, in the Upper West Side in Manhattan, and in 1991 founded Solera Restaurant. Since its opening, in the days when the paella was made ??in Manhattan in a pot with a lid instead of the regional authentic way as made in Valencia, with a pan, the Executive Chef of Solera Restaurant at that time, Dominick Cerrone, began incorporating Spanish regional dishes prepared with fidelity to its Spanish origin, one of the marks of the restaurant.

The history of the Spanish-American International Award began in 2012, when the writer and filmmaker Artur Balder was awarded. Artur Balder, now a US citizen, directed the documentary Little Spain, which displayed the historical memory of the Spanish district of Manhattan. The Spanish-American International Prize was created to support emigrants who have made an outstanding contribution to the Spanish-American identity and the American heritage.

Kenya government fires health worker strikers over failure to ‘report back to work’

The Kenyan government has dismissed 25,000 striking health workers, mostly nurses, citing failure to heed government orders to recommence work and concern for the welfare of hospital patients. Speaking on behalf of the government, Alfred Mutua stated the workers were dismissed “illegally striking” and “[defying] the directive … to report back to work”, which he called “unethical”. The government asks that “[a]ll qualified health professionals, who are unemployed and/or retired have been advised to report to their nearest health facility for interviews and deployment”, Mutua stated.

The workers, who had been on strike for four days, were wishing to have improvements made to their wages, working conditions, and allowances. The strikes have caused a significant number of Kenyan hospitals to cease operations. According to Kenya Health Professionals Society spokesperson Alex Orina, the average monthly wage plus allowances for health workers in Kenya is KSh25,000 (£193, US$302 or €230) approximately. With an increasing number of reports of patients neglected in hospitals emerging, two trade unions met with the Kenyan government yesterday and negotitated a return to work, although a significant proportion of demonstrators defied the agreement, The Guardian reported.

Orina told Reuters the dismissals were “cat-and-mouse games, you cannot sack an entire workforce. It is a ploy to get us to rush back to work, but our strike continues until our demands are met”. Frederick Omiah, a member of the same society, believed the government’s actions would “make an already delicate and volatile situation worse”, expressing concern that demonstrations may continue in the capital Nairobi, amongst other locations. Kenya Medical Practitioners, Pharmacists and Dentists Union chairperson Dr. Victor Ng’ani described government actions as “reckless”.

Mutua said the health workers were “no longer employees of the government” and had been eliminated from the payroll. While Ng’ani told the BBC of difficulties with finding other workers as skilled and experienced, Mutua reportedly stated that this would not be an issue. “We have over 100,000 to 200,000 health professionals looking for work today,” Mutua commented. “There will be a lag of a day or two … but it is better than letting people die on the floor, at the gate, or suffer in pain”.

Acting teacher and director Milton Katselas dies at age 75

Acting teacher and director Milton Katselas died Friday at age 75, after suffering from heart failure at Cedars-Sinai Medical Center in Los Angeles, California. He began the Beverly Hills Playhouse in 1978 and taught acting classes there to noted actors including George Clooney and Gene Hackman. Katselas is survived by a sister and two brothers.

Katselas directed an off-Broadway production of Edward Albee‘s The Zoo Story, and received a Tony Award nomination for his 1969 direction of Butterflies are Free. Actress Blythe Danner won a Tony Award for her role in Butterflies are Free under Katselas’ direction. He moved to California to direct the film version of that play, and went on to direct films and television movies. Actress Eileen Heckart received an Academy Award for her role in the film version of Butterflies are Free.

Katselas directed the San Francisco and Los Angeles productions of the play P.S. Your Cat Is Dead! by playwright James Kirkwood, Jr. In his author’s notes in the publication of the script, Kirkwood acknowledged Katselas, and wrote that the plays were “directed with incredible energy and enthusiasm by Milton Katselas, to whom I am extremely indebted”.

Katselas directed the television movie Strangers: Story of a Mother and Daughter, and actress Bette Davis received an Emmy Award for her role in the movie. Katselas taught many famous actors including Michelle Pfeiffer, Richard Gere, Robert Duvall, Jack Lemmon, Al Pacino, Goldie Hawn, Christopher Walken, Burt Reynolds, George C. Scott, Elizabeth Taylor, Richard Burton, Alec Baldwin, and Patrick Swayze. Katselas was credited with being able to nurture actors with raw talent so that they could develop strong Hollywood careers. He utilized innovative techniques in his courses – one course called “Terrorist Theatre” had a simple premise: successfully get an acting role within six weeks or leave the course.

He grew up in Pittsburgh, Pennsylvania to parents who had immigrated from Greece, and graduated from Carnegie Mellon. He studied acting with Lee Strasberg in New York at the Actors Studio, and received advice from directors Joshua Logan and Elia Kazan.

Katselas was a prominent Scientologist, and a July 2007 profile on Katselas in The New York Times Magazine observed that some of his students stopped taking courses at the Beverly Hills Playhouse because they felt they had been pressured to join the Church of Scientology. According to the article, Katselas credited Scientology founder L. Ron Hubbard “for much of his success in life”, and one of his students works at Scientology’s Celebrity Centre. The article commented that some in Los Angeles view the Beverly Hills Playhouse as “a recruitment center for Scientology”.

Katselas met L. Ron Hubbard after moving to California, and began studying Scientology in 1965. The New York Times Magazine reported that he had reached the level of “Operating Thetan, Level 5, or O.T. V.” in 2007. According to The New York Times Magazine when Scientologists proceed up the “The Bridge to Total Freedom” they learn the story of Xenu, and that: “75 million years ago the evil alien Xenu solved galactic overpopulation by dumping 13.5 trillion beings in volcanoes on Earth, where they were vaporized, scattering their souls.” A Church of Scientology publication, Source, lists Katselas as reaching O.T. V. in 1989.

Though some actors felt pressured to join the Church of Scientology after taking courses at the Beverly Hills Playhouse, at least one individual felt Katselas was not active enough with the organization. Actress Jenna Elfman left the Beverly Hills Playhouse because she felt Katselas was not committed enough to Scientology. Katselas had previously directed Elfman in half of Visions and Lovers: Variations on a Theme, two one-act plays about relationships that he had written himself. In 1999 Katselas had planned to adapt the script of Visions and Lovers to a film version, and Elfman was set to reprise her role from the play. In an article in Variety about the project, Elfman commented on her experience working with Katselas: “He is brilliant, and knows me so well as a person and an actress that he gets the most out of me.”

Other prominent Scientologist actors who have studied under Katselas include Giovanni Ribisi, Jason Lee, and Leah Remini. According to Rolling Stone, Katselas also recruited actress Kelly Preston to Scientology. Actress Nancy Cartwright (the voice of Bart Simpson), told Scientology publication Celebrity that Katselas motivated her to get more active in Scientology, and she stated she took the organization’s “Purification Rundown” and her life “took off completely”.

Anne Archer was introduced to Scientology while studying at the Beverly Hills Playhouse, as was former Scientologist and now outspoken critic actor Jason Beghe. Beghe told Roger Friedman of FOX News in April 2008 that “He [Katselas] gets kickbacks”, and that he was brought to a Scientology center by fellow Beverly Hills Playhouse classmate Bodhi Elfman, Jenna Elfman’s husband. In a 1998 article for Buzz Magazine, Randye Hoder wrote “In his class, Katselas is careful not to label anything as a tenet of Scientology, but there is no question that the church’s influence seeps into the playhouse.”

Anne Archer’s husband and fellow Scientologist, producer Terry Jastrow, commented to The New York Times Magazine that Katselas changed the way he experiences life on a day-to-day basis: “I go out in the world and look at human behavior now. I see a woman or man interacting with a saleslady, and I see the artistry in it. Life is an endless unspooling of art, of acting, of painting, of architecture. And where did I learn that? From Milton.”

Actor Anthony Head of Buffy the Vampire Slayer spoke highly of Katselas in a 2002 interview with San Francisco Chronicle: “He’s this wonderfully intuitive teacher and his premise is basically: The only real barriers are the ones we put in front of ourselves. If you say, ‘My character wouldn’t do that’ — bollocks! Ultimately it’s you who wouldn’t say that. Who knows what your character might do.” In the acknowledgements of her 2004 autobiography Are You Hungry, Dear?: Life, Laughs, and Lasagna, actress Doris Roberts wrote: “I thank my friend and acting teacher, the incredible Milton Katselas, for his insights, wisdom, and inspiration, which have helped make me the actress that I am.”

Katselas authored two books: Dreams Into Action: Getting What You Want, first published in 1996 by Dove Books, and Acting Class: Take a Seat, which came out earlier this month. Dreams Into Action, a New York Times Bestseller, sought to modify motivational acting exercises to the field of business.

In an interview in the 2007 book Acting Teachers of America, Katselas commented on his experiences as an acting teacher over the years: “I have very special teachers here at the Beverly Hills Playhouse—some have been with me for over twenty-five years. I believe that to make a difference over the long haul, we need to train teachers. I really care about the craft of acting. It’s absolutely necessary to take the time and patience to really develop an actor.”
